2. Description of the Service

AI Peeps is an online AI entertainment platform. The Service may allow users to create, customise, browse, and interact with fictional AI characters, generate text conversations, generate or edit images and videos, upload media as inputs or references, purchase digital credits, purchase memberships, and redeem prepaid access codes.

The Service may include adult-oriented fictional AI content. However, all use of the Service must remain lawful and compliant with these Terms. Adult content involving minors, persons who appear to be minors, non-consensual intimate depictions, or unlawful real-person abuse is strictly prohibited.

The Service is provided for entertainment and creative purposes only. AI outputs may be fictional, inaccurate, unrealistic, offensive, unexpected, or unsuitable for your intended use. You are responsible for reviewing and deciding whether to use, save, publish, or share any output.

3. Adult-Only Service

You must be at least 18 years old to access or use the Service. If you are under 18, you must not create an account, browse adult content, purchase products, upload content, generate content, or otherwise use the Service.

By using the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into these Terms;
• You will not allow minors to access your account or use the Service;
• You will not use the Service to create, request, upload, store, or share content involving minors or persons who appear to be minors in sexual, nude, intimate, or adult contexts.

We may suspend or terminate accounts where we suspect underage access or any attempt to involve minors in prohibited content.

4. Account Registration and Security

To access certain features, you may need to create an account. You agree to provide accurate information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must not sell, transfer, share, or allow unauthorised access to your account.

5. User Content and Uploaded Media

"User Content" means any content, prompt, message, image, video, file, character description, scenario, instruction, reference material, or other material that you submit, upload, create, generate, save, publish, or otherwise provide through the Service.

You are solely responsible for your User Content and for your use of the Service. You must ensure that you have all rights, permissions, licences, and consents required to upload, use, transform, generate from, publish, or share any User Content.

If you upload images, videos, or other media containing real or identifiable people, you represent and warrant that you either own the content or have all necessary rights, permissions, and explicit consent from the person depicted for the intended use.

You must not upload or use images of real people to create non-consensual nude, sexual, intimate, defamatory, harassing, humiliating, deceptive, or otherwise unlawful depictions of them. This includes, but is not limited to, non-consensual "nudification", sexual deepfakes, or realistic sexualised depictions of identifiable real people without their explicit consent.

We may require you to confirm that you own uploaded media or have the necessary rights and consent to use it. We may reject, remove, restrict, or review uploaded media where we believe it may violate these Terms or the law.

6. AI-Generated Content

The Service may generate text, images, videos, character responses, scenarios, descriptions, or other AI-generated outputs based on your prompts, uploaded media, selected settings, or interactions.

AI-generated content may be unpredictable and may not reflect your intentions. You are responsible for reviewing AI-generated content before saving, publishing, sharing, downloading, or otherwise using it.

Subject to your compliance with these Terms and applicable law, we do not claim ownership over your private prompts or private AI-generated content. However, you acknowledge that similar or identical outputs may be generated for other users, and no exclusive rights are granted to you merely because an output was generated through your account.

You must not use AI-generated content in a way that violates the law, the rights of others, these Terms, or the rules of any third-party platform where you publish or distribute the content.

7. Licence You Grant to Us

You retain any rights you may have in your User Content. However, by uploading, submitting, creating, generating, or storing User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, display, transmit, modify, and use that User Content solely as necessary to:

• Provide, operate, and maintain the Service;
• Generate AI outputs requested by you;
• Store and display content in your account;
• Provide chat memory, conversation continuity, and related features;
• Moderate content and enforce these Terms;
• Investigate abuse, fraud, security issues, disputes, or legal requests;
• Improve, test, and debug the Service, where legally permitted.

We will not use content containing or identifying real persons for public marketing without a lawful basis and, where required, your consent.

8. Prohibited Content and Conduct

You must not use the Service to create, upload, generate, request, store, publish, share, distribute, or attempt to obtain content that is illegal, abusive, exploitative, or prohibited by these Terms.

Strictly prohibited content and conduct includes:

• Any content involving minors, persons under 18, or persons who appear to be under 18 in sexual, nude, intimate, erotic, fetish, or adult contexts.
• Child sexual abuse material, child exploitation material, grooming, sexualisation of minors, or any attempt to create or simulate such content.
• Uploading, generating, requesting, or pretending to depict underage individuals in adult or sexual contexts, even if fictional, stylised, animated, AI-generated, or described as fantasy.
• Non-consensual intimate images, sexual deepfakes, nudification, or sexualised depictions of real or identifiable people without explicit consent.
• Content that violates intellectual property rights, privacy rights, publicity rights, image rights, contractual rights, or any other rights of another person or organisation.
• Content that impersonates, defames, harasses, blackmails, threatens, humiliates, or exploits another person.
• Content involving sexual violence, coercion, trafficking, exploitation, or unlawful sexual services.
• Content that promotes terrorism, violent extremism, serious violence, self-harm, or criminal activity.
• Attempts to bypass, disable, reverse engineer, overload, scrape, attack, or interfere with the Service, its infrastructure, safety systems, payment systems, or moderation systems.
• Fraudulent purchases, payment abuse, chargeback abuse, unauthorised resale, code abuse, automated account creation, spam, or other abusive behaviour.

8.1 Zero Tolerance for Human Trafficking, Sex Trafficking, and Abuse

We strictly prohibit any use of the Website and the Service to promote, facilitate, advertise, solicit, arrange, enable, profit from, or engage in human trafficking, sex trafficking, forced labour, sexual exploitation, sexual servitude, child sexual abuse or exploitation, or any form of physical, sexual, or psychological abuse of any person.

This includes, without limitation, using the Service to recruit, transport, harbour, advertise, or solicit any person for commercial sexual exploitation or forced labour; to coordinate, finance, or benefit from such activity; or to create, request, upload, or distribute content that depicts, promotes, normalises, or is intended to facilitate trafficking, sexual abuse, or exploitation, whether the persons involved are real, identifiable, fictional, or AI-generated.

We maintain a zero-tolerance policy toward such activity. Where we identify or reasonably suspect it, we will suspend or terminate the relevant accounts, preserve relevant records and evidence, cooperate with our payment providers and with law enforcement, and report suspected human trafficking, sex trafficking, child sexual abuse material, or related abuse to the appropriate authorities and organisations (including, where applicable, the National Center for Missing & Exploited Children (NCMEC)).

If you become aware of any content or activity on the Service that may involve human trafficking, sex trafficking, or abuse, please report it immediately to admin@aipeeps.com.

We may remove content, reject uploads, block generation requests, restrict features, suspend accounts, terminate accounts, refuse refunds, preserve evidence, or report unlawful activity to relevant authorities or partners where appropriate.

9. Moderation and Enforcement

We may use automated tools, technical filters, user reports, manual review, logs, and account-level monitoring to detect and respond to content or conduct that may violate these Terms.

We may review prompts, uploaded media, generated content, chat data, account records, payment records, technical logs, or user reports where necessary for safety, abuse prevention, legal compliance, fraud prevention, dispute handling, or enforcement of these Terms.

If we determine, in our reasonable discretion, that you have violated these Terms, we may take action including:

• Warning you;
• Rejecting or removing content;
• Restricting access to specific features;
• Suspending or terminating your account;
• Removing credits, benefits, or generated content obtained through abuse;
• Refusing refunds where permitted by law;
• Reporting suspected illegal content or conduct to relevant authorities, platforms, payment processors, or marketplace partners.

We are not required to monitor all content and we do not guarantee that all prohibited content will be detected. You remain responsible for your own use of the Service.

10. Intellectual Property

The Service, including its software, interface, design, branding, trademarks, logos, databases, systems, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws.

You must not copy, modify, reverse engineer, scrape, reproduce, distribute, sell, rent, exploit, or create derivative works based on the Service except as expressly permitted by these Terms or by applicable law.

You must not use the Service to infringe the intellectual property rights of others. If you believe that content on the Service infringes your rights, you can contact us at admin@aipeeps.com.

11. DMCA and Copyright Infringement Notices

If you believe that content available on or through the Service infringes your copyright, you may submit a written notice to us requesting removal of the allegedly infringing content. Your notice must include the following information:

• A description of the copyrighted work you claim has been infringed;
• A description of the content on the Service that you claim is infringing, with sufficient detail for us to locate it (such as a URL or screenshot);
• Your name, postal address, email address, and telephone number;
• A statement that you have a good-faith belief that the use of the content is not authorised by the copyright owner, its agent, or the law;
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the copyright owner's behalf;
• Your physical or electronic signature.

We will review valid notices and take appropriate action, which may include removing or disabling access to the allegedly infringing content. We may also notify the user who uploaded or generated the content.

Repeat infringers may have their accounts suspended or permanently terminated.

Please note that submitting a false or misleading DMCA notice may expose you to legal liability.

12. Credits, Subscriptions, Memberships, and Prepaid Codes

The Service may offer digital credits, including PeepCoins, subscription plans, membership benefits, prepaid access codes, gift cards, or similar digital products.

Digital credits and prepaid codes have no cash value, are not legal tender, are not stored-value money, and cannot be exchanged for cash except where required by law. They may only be used inside the Service for eligible digital features.

Purchased digital credits generally do not expire unless otherwise stated at the time of purchase. Promotional, bonus, trial, subscription-included, or weekly allowance credits may expire or reset according to the rules displayed at the time they are granted.

Subscription or membership benefits may include access to certain features, allowances, discounts, credits, or other digital benefits. The exact benefits may vary by plan and may be updated over time.

Some products sold directly through the Service or through third-party marketplaces may be one-time prepaid access codes rather than automatically recurring subscriptions. The product page or checkout page will indicate whether a product renews automatically or is a one-time purchase.

You are responsible for redeeming prepaid codes correctly. We are not responsible for codes lost, resold, transferred, shared publicly, stolen, or redeemed by another person because of your actions or negligence.

13. Payments, Third-Party Providers, and Marketplaces

Payments may be processed by third-party payment processors, crypto payment providers, marketplace partners, or other billing providers. These providers may have their own terms, privacy policies, fees, fraud checks, refund rules, dispute procedures, and compliance requirements.

We may offer products through third-party marketplaces such as G2A.COM or similar partners. If you purchase through a third-party marketplace, your purchase may also be governed by that marketplace's terms and policies.

We are not responsible for payment delays, payment failures, account holds, blockchain transaction delays, exchange-rate changes, marketplace issues, or other problems caused by third-party payment or marketplace providers, except where required by law.

You must not use stolen payment methods, unauthorised accounts, fraudulent chargebacks, fake billing information, or any other payment abuse. We may suspend or terminate accounts associated with payment abuse.

14. Refunds and Cancellations

Because the Service provides digital content, digital credits, AI generation, and immediate access to online features, purchases are generally final once credits, codes, generations, or membership benefits have been delivered, redeemed, used, or made available, except where required by applicable law.

Refund eligibility may depend on the product type, payment provider, marketplace rules, local consumer law, whether the digital product has been used or redeemed, and whether there has been a violation of these Terms.

We may refuse refunds, suspend accounts, or remove benefits where we reasonably believe there has been fraud, abuse, chargeback abuse, violation of these Terms, or misuse of the Service.

If you purchased through a third-party marketplace or payment provider, you may need to request refunds or resolve payment issues through that provider's process.

14.1 Subscription Billing and Auto-Renewal

Subscription and membership plans that are shown as recurring renew automatically at the end of each billing period (for example, monthly or yearly) at the price displayed at the time of purchase, until they are cancelled. The billing period and price for your plan are shown at checkout and in your account.

Subscription or membership access purchased with a gift card or prepaid code, including through third-party marketplaces such as G2A.COM or Telegram, is not a recurring subscription. It is a one-time purchase that grants access only for the fixed period indicated at the time of purchase (for example, one month or one year). It does not renew automatically, you are not charged again, and there is nothing to cancel: the access simply ends when the indicated period expires.

14.2 How to Cancel a Subscription

If you have a recurring subscription, you can cancel it at any time from the Subscription / Premium panel in your account, or by contacting us at admin@aipeeps.com. Gift-card and prepaid-code purchases (including through G2A.COM or Telegram) do not renew and do not need to be cancelled: they end automatically when the paid period expires.

Cancellation stops future renewals and future charges. You will keep access to your subscription benefits until the end of the current paid billing period, after which the subscription will not renew. Cancelling does not, by itself, delete your account or remove credits you have already received. We do not provide partial refunds for the unused portion of a billing period once a subscription has started, except where required by applicable law.

14.3 Recurring Transaction Notifications and Authorisation

For recurring subscriptions paid by card, we will notify the cardholder by email at least 7 days before each recurring transaction, stating the amount and the date on which the transaction will be processed.

Where more than 6 months have elapsed since the previous recurring transaction, or where the terms of the subscription change (including the amount, the billing date, or any other term of the agreement), a new cardholder authorisation will be obtained before the next transaction is processed.

15. Service Availability and Changes

We aim to provide a reliable Service, but we do not guarantee that the Service will always be available, uninterrupted, error-free, secure, or compatible with every device, browser, payment method, or third-party provider.

We may modify, suspend, replace, limit, or discontinue any part of the Service at any time, including models, characters, generation tools, prices, credits, subscription features, allowances, or available payment methods.

We may perform maintenance, updates, migrations, security changes, or emergency actions without prior notice where necessary.

16. Third-Party Services and Links

The Service may integrate with or link to third-party services, including AI model providers, hosting providers, payment processors, crypto payment providers, analytics tools, marketplaces, social platforms, or external websites.

We are not responsible for third-party services, websites, policies, content, outages, payment failures, or actions. Your use of third-party services may be subject to their own terms and privacy policies.

17. Privacy

Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that your personal data will be processed as described in the Privacy Policy.

18. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that AI-generated content will be accurate, lawful, original, non-infringing, safe, suitable, or acceptable for your intended use. You are responsible for reviewing and using AI-generated content lawfully and responsibly.

We do not provide legal, financial, medical, psychological, professional, or other regulated advice through the Service.

19. Limitation of Liability

To the maximum extent permitted by applicable law, AI Peeps Lab di Biscione Valerio will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, business interruption, or loss arising from your use of or inability to use the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid to us for the Service during the three months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

20. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless AI Peeps Lab di Biscione Valerio from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from:

• Your use or misuse of the Service;
• Your User Content;
• Your violation of these Terms;
• Your violation of applicable law;
• Your violation of any third-party rights, including privacy, publicity, image, or intellectual property rights;
• Your upload or use of media without required rights, permissions, or consent;
• Your payment fraud, chargeback abuse, or marketplace abuse.

21. Suspension and Termination

You may stop using the Service at any time. You may request account deletion by contacting us or using any account deletion tool available in the Service.

We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe that:

• You violated these Terms;
• You used the Service unlawfully or abusively;
• Your account creates legal, safety, payment, fraud, or security risk;
• We are required to do so by law, payment providers, marketplace partners, or authorities;
• Continuing to provide the Service to you would expose us, users, partners, or third parties to unacceptable risk.

Termination or suspension may result in loss of access to your account, credits, generated content, subscriptions, prepaid benefits, or other Service features, except where otherwise required by law.

22. Consumer Rights

Nothing in these Terms is intended to limit rights that you may have under mandatory consumer protection laws that cannot be waived by contract.

If you are a consumer located in the European Union, you may have specific rights under EU and national consumer protection laws. However, digital content or digital services provided immediately with your consent may have different cancellation rules under applicable law.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, our business model, legal requirements, payment providers, marketplace partners, safety requirements, or technical features.

When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide notice through the Service, by email, or by other reasonable means.

Your continued use of the Service after updated Terms become effective means that you accept the updated Terms. If you do not agree with the updated Terms, you must stop using the Service.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, without prejudice to any mandatory consumer protection rights that may apply in your country of residence.

Where permitted by law, any dispute arising from or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts of Italy.

25. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be interpreted or replaced to the extent necessary to achieve its original purpose as closely as possible under applicable law.
